Sometimes the diversity card just doesn't work. The immigrant is denied opportunity because of their immigrant status or because their language skills are insufficient or because they lack the necessary U.S. license. What happens later is that we have a multi-lingual entrepreneur who could have been the "qualified talent" who could have filled the req.
